Emphasis: it depends a lot on some conditions.

If I put something up with the explicit notification that I MUST BE INFORMED BEFORE ANYTHING IS DONE FOR PERMISSION TO BE GRANTED, then I can get pretty darned annoyed if they don't do so. And in a quite painful manner.

If I put it up without any such demands, then I am cool with them mentioning me. I generally believe that people should be credited for their work.

To be honest I usually have no problem with it. I've seen my avatars and emoticons used in various places and I'm normally quite happy to see them being used.

Saying that I do prefer for people to ask permission first and I don't think I've never said no to anybody who has done.

I have actually felt sorry for people who have been done for "ripping" my stuff. E.g. Some kid who got banned from a site for using one of my emotes as an avatar. He'd actually requested permission I just hadn't got back to him on it yet but some pedantic f****r on the site hounded him about it. I really didn't mind him using it.

The only time I'd get pissed is if they claimed the work as there own.

Anyone's welcome to any of my stuff, as long as they aren't making a profit off of it. And I do mean any of my stuff: emoticons, graphic art, poetry, prose, etc. I'm not a big fan of current copyright law, and believe in the free, uninhibited sharing of information. If I were ever told that someone was using or distributing my work, I wouldn't persue any action against them. Unless they were making a profit from it. If anyone makes money off of something I've done, it'd better be me! :shakefist:

Just like any other form of art, emoticons belong to the creator and are copyrighted pieces of artwork. Unless stated in the description or somewhere that they are free for use, or are under a Creative Commons License then they can not be used without permission.

I find it disgusting that people use them, even if they credit the original artist without asking him. Unfortunately, many artists are happy that their work is being used so bother them even though its wrong.

Don't get me wrong, I'm usually more than happy for people to use some of my stuff, but only if they contact me first.

As long as they ask, I'd be happy to see my emotes in use on another website, I'd feel honored... but if they did it without asking it's like... wow... cool, wait.... no... not cool! POLICE!!

No need to ask. My favorite emoticonist of all time is Fool and on his site he offers his emotes freely to anyone who wants to use them, he even offers free hotlinking. I admire generosity like that and choose to emulate him.
